Terms of Service
These terms are an agreement between you and OD Bosnadev vl. Mirza Pasic ("Weekbird", "we", "us") for the use of Weekbird at weekbird.app and app.weekbird.app, its API, MCP server, ChatGPT app and browser extension (together, the "Service"). If you use the Service for an organization, you accept these terms for it and confirm you may bind it.
1. Eligibility and accounts
- You must be at least 16 and able to form a binding contract. The Service is for business and professional use.
- Give accurate account details and keep them current. Keep your sign-in methods secure. You are responsible for activity under your account.
- Tell us at hey@weekbird.app if you suspect unauthorized access.
2. Workspaces and teams
- Content, channels and billing belong to a workspace. The workspace owner controls its members, roles, connected channels, subscription and deletion.
- Members act within the role the owner gives them. An owner is responsible for the people they invite and what they do in the workspace.
- If you manage social accounts for clients, you confirm you have their permission to connect those accounts, publish for them and process their audience data.
3. Your content
- You keep all rights in the posts, media, messages and other material you put into the Service ("Your Content").
- You give us a limited licence to host, copy, process, transmit and display Your Content only to provide, secure and support the Service for you. We do not use Your Content to advertise, and we do not sell it.
- You are responsible for Your Content and confirm you have the rights needed to publish it, including any third-party material, music, likenesses and trademarks.
4. Social networks and other third-party services
- Weekbird publishes and reads data through the official interfaces of social networks and other services you connect. Your use of each one stays subject to its own terms and policies. See our platform terms list.
- Those services decide what their interfaces allow. They can change limits, remove features or revoke access at any time. When that happens, the matching Weekbird feature may change or stop. We will tell you when a change affects a feature you use, but we are not responsible for decisions made by those services.
- A post published to a network is governed by that network once it is there. Deleting it in Weekbird may not delete it from the network.
- You can disconnect a channel at any time in Weekbird or in the network's own settings.
5. AI features
- Some features use AI models to draft text, suggest replies, generate images or video, and research topics. Outputs are generated automatically and can be inaccurate, incomplete or similar to content others receive. Review every output before you publish or send it.
- As between you and us, you own the outputs created for you, to the extent the law allows.
- We do not use Your Content or outputs to train AI models. The AI providers we use process requests to return results to you. Our subprocessor list names them.
- Do not use AI features to create content that is deceptive about who made it where a network or law requires disclosure, to build a competing model, or for any purpose in our Acceptable Use Policy.
- AI features use monthly credits set by your plan. Unused credits do not carry over.
6. API, MCP and connected assistants
- You can let software act in your workspace through API keys, our MCP server or the Weekbird ChatGPT app. Access is limited to the scopes you grant. Actions taken with your keys or authorizations count as your actions.
- Keep keys secret and revoke ones you no longer use. Where Weekbird asks for your approval before an assistant acts, check the action before you approve it.
- We may set rate limits and suspend keys that put the Service or other customers at risk.
7. Plans, trials and payment
- Paid plans are sold by Dodo Payments, our Merchant of Record and reseller. Dodo is the seller on your order, processes your payment, issues your invoice and handles sales tax and VAT. Dodo's Buyer Terms also apply to your purchase.
- Prices and plan limits are shown on our pricing page and at checkout before you pay.
- A free trial needs a payment method. Unless you cancel before the trial ends, the plan you chose starts and is charged at the end of the trial.
- Subscriptions renew automatically for the same period until cancelled. You can cancel renewal at any time in billing settings; you keep access until the end of the paid period.
- Refunds follow our Refunds and cancellation policy.
- We will give at least 30 days' notice of a price increase for an existing subscription. It applies from your next renewal after the notice period.
8. Acceptable use
You must follow our Acceptable Use Policy. We may remove content or suspend access that breaks it, as described there.
9. Our service and intellectual property
- We own the Service, including its software, design and brand. These terms give you a right to use it while your account is in good standing; they do not transfer ownership.
- If you send us feedback, we may use it without obligation to you.
- We keep improving the Service and may add, change or remove features. If we remove a material paid feature during your paid period, you may cancel and ask for a pro rata refund of the unused period.
10. Privacy and data protection
Our Privacy Policy explains how we handle personal data. When we process personal data in Your Content or your audience data for you, we act as your processor. Business customers can request a data processing agreement at privacy@weekbird.app.
11. Suspension, termination and your data
- You can delete your workspace or account in settings. Active subscriptions must be cancelled first.
- We may suspend or end access if you seriously or repeatedly break these terms, if required by law, or to protect the Service, other customers or the networks we connect to. Where reasonable, we will warn you first and give you a chance to fix the problem.
- You can export your workspace data at any time while you have access. After deletion, data is removed as described in our Privacy Policy.
12. Disclaimers
We provide the Service with reasonable skill and care, but "as is" and "as available". We do not promise that it will be uninterrupted, error-free, or that a network will accept every post. Nothing in these terms limits rights you have under consumer law that cannot be excluded.
13. Limitation of liability
- Neither party is liable for indirect or consequential loss, or for lost profits, revenue, goodwill or data, except where the law does not allow this to be excluded.
- Our total liability for all claims in any 12-month period is limited to the greater of the fees you paid for the Service in the 12 months before the claim and EUR 100.
- These limits do not apply to liability for death or personal injury caused by negligence, fraud, or anything else that cannot be limited by law.
14. Your responsibility for claims
If a third party makes a claim against us because of Your Content or your breach of these terms or the Acceptable Use Policy, you will cover our reasonable costs and losses from that claim.
15. Changes to these terms
We may update these terms. For material changes we will email workspace owners at least 30 days before they take effect. If you do not agree, you can cancel before then; continuing to use the Service after the effective date means you accept the new terms.
16. Governing law and disputes
These terms are governed by the laws of Bosnia and Herzegovina. The courts of Sarajevo have jurisdiction, except that consumers keep the right to bring proceedings in the courts of the country where they live. Before starting proceedings, please contact us so we can try to resolve the issue.
17. General
- If a provision is unenforceable, the rest of these terms stays in effect.
- We may assign these terms as part of a merger or sale of the Service; we will tell you if that happens. You may not assign them without our consent.
- Neither party is responsible for delays caused by events outside its reasonable control.
- These terms, with the policies they link to, are the whole agreement about the Service.
